hiya i'm going to go down the citizens advice on monday, but was wondering if anyone can help in the meantime.
heres the story:
i have been on 3 months probation for my job. in my terms it says i cant take any holiday within 90 days of joining the company. i have just had my probation extended by a month. as a result of this and a few other things, i quit today. i have been owed a day in lieu for about a month. so in my resignation letter, i proposed that i take my day in lieu and my holiday days that i have accrued in the last 3 months (4 and a half days) in lieu of my notice.
apparently my area manager told my manager that as i am in my probation period, that i am not entitled to be paid for my accrued holiday pay. i think this is wrong, but i want to know for sure before i go and kick up a stink.
i may be wrong, but i'm under the impression that as long as i have legally accrued that holiday pay, that i am entitled to take it or be paid for it.

can anyone help?

I would of thought that legally they have to pay your holiday pay :confused3
