Difference between scalping and ebay?

What's the difference between scalping and buying a ticket through ebay?

There is no difference unless the ticket are bought at face value or below. Scalping is when the tickets are sold for a profit. Most of the tickets on eBay are sold for a profit, therefore, it's scalping.

Thanks for the quick reply. I kinda thought it was the same but since I had never heard of anyone getting busted through ebay for doing scalping I thought somehow it was legal.

depends on what state you are in. In Ohio I know it's legal to sell the tickets for more than face value (dh did LOTS of research on this before we listed some tickets we had) In Michigan it is NOT legal to sell for more than face value.

Do some research on your state to find out. :)

with ebay you have got to be carefully!!!

the only ones that can be sold - the old ones - you can't tell by looking at the ticket if it has been used or not....

the new ones can not be resold.....

they have the finger scan identification. So although it could happen it is unlikely your finger scan would match the person who sold them to you.....

besides on the WDW tickets (on all WDW tickets) - Disney says that reselling these tickets is against their rules.....so they won't honor them....

I won't buy tickets for WDW on ebay....

not worth the risk!!!!

think how silly you would feel to spend a $100 for what you though were 4 day passes - only to be told at the gate that the tickets were completely used.... think about it!

It is illegal to resell tickets in Missouri for higher than face value, but across the state line in Kansas it is legal.

Oh, hey, I didn't know the OP was referring to WDW tickets. I thought it was just a "tickets" in general question...

It was about tickets in general. I just couldn't figure out how scalping could be illegal but buying them through ebay was legal. I didn't know it depended on each individual state.

i was at Best Buy for Black Friday and there were cops standing every few hundred feet. anyway, in order to get a few of the products you had to have a certain flier stating that you were one of the few that could buy the product(they only had a few of the certain items). well the employees decided instead of walking down the line that it was "too cold" and gave a wad of the fliers to people in the front who decided to start selling them to us in the back. these "fliers" that were originally handed out for free were being sold to people for ...the highest price i believe was, $60. i asked the cop "isn't that considered scalping?" and then he smiles and says to me "scalping is leagal in the state of New York now!"......so i really don't know the answer but if you find out i'd love to know. i really had no clue of this new "law" in NY that we are allowed to scalp things.

Scalping: I have a ticket with a face value of $20. I have it for sale for $100.

Ebay: I have a ticket with face value of $20. I start the auction at $1. If it gets bid past the $20 mark then that is completely fair and not illegal.

I would never buy a ticket through Ebay...espically a WDW ticket. There are plenty of ways to get the tickets at discount through legal and safe means.

the price the ticket sells for determines if the sale violates a state law. It doesn't matter if the price is set by the seller or is set by auction. Some states don't allow re-sale, some only allow re-sale for the price paid, some allow for a markup and some states have no limits.
